Bangladesh Payroll & Employment of Record – Employment Contracts

Work visas may be awarded for single, double, or triple entries for those who intend to enter and depart the nation multiple times throughout the course of their visa. The cost of the visa will vary based on the category selected by the employee. Work permits are usually valid for 3 months but can be extended.

Probation Periods

Clerical workers are entitled to a six-month probationary term, whereas other workers are entitled to a three-month probationary period.

Notice Periods

In Bangladesh, employers are normally required to offer written notice of 120 days for monthly rated workers and 60 days for other workers, or comparable compensation in lieu, when terminating employment for other reasons. In addition, for every year worked, the employee is entitled to 30 days of salary.

Minimum Wage

The minimum wage in Bangladesh is 1,500 taka per month for all economic sectors that are not governed by industry-specific rates (in the garment industry the minimum wage is 5,300 taka per month). The National Minimum Wage Board establishes the national minimum wage in a tripartite forum industry by industry every five years.

Working Hours

Each employee can work for a maximum of eight hours every day. Any shift longer than six hours should include a one-hour lunch break, and a five-hour shift should include a 30-minute lunch break. Workers are permitted to work up to 48 hours a week. In the event of overtime, they can work up to ten hours per day and sixty hours per week. Each worker on a night shift must be provided a 24-hour rest between shifts.

Overtime

Overtime is defined as work done on any day or week for more than the hours specified in the Labour Act 2006, i.e., 8 hours per day and 48 hours per week. The maximum working hours, including overtime, in any week may not exceed sixty hours, and the average weekly working hours in any year may not exceed fifty-six hours. As a result, the maximum amount of overtime is two hours per day and twelve hours per week. Overtime compensation is available to all employees. Section 108 of the Labour Act establishes the overtime rate at double the regular rate of basic salary, dearness allowance, and, if applicable, ad hoc or interim wage. Overtime is paid at twice (or 200 percent) of the base salary rate, plus a “dearness allowance” and, if appropriate, interim pay.

Non Compete

A non-compete clause in a contract or a non-compete agreement prohibits an employee from competing with the employer.

Severance

Employees with at least one year of service who are laid off are normally entitled to one month’s notice or pay in lieu of notice, as well as 30 days of compensation for every year served.

Termination

  • Employees may be terminated for physical or mental incapacity, or for continuing ill-health as confirmed by a medical practitioner. If the employee has been with the company for at least one year, he or she is entitled to 30 days of pay for each year of service.
  • Employees who have been convicted of a felony or found guilty of misbehaviour are not entitled to notice or severance pay.

Workers Compensation

  • The highest amount of compensation that may be granted to the dependents of a deceased worker in situations of workplace deaths under the Bangladesh Labour Act 2006, as amended 2013, (‘BLA’) is Taka 1,00,000. (one lakh).
  • The money must be submitted at the Labour Court by the employer in the event of death. In such circumstances, the pay-outs are rather quick, and bereaved family members of the dead worker may get them within a year or two. If a worker is permanently disabled as a consequence of a working injury, compensation will be granted in the amount of Taka 1,25,000. (one lakh twenty five thousand).
  • Workers who are temporarily disabled may be compensated for the duration of their disability or one year, whichever is less.
  • Thus, the compensation payable for the first two months will be the whole monthly wage, the compensation payable for the following two months will equal two-thirds of the monthly wage, and the compensation due for the remaining months will be half of the monthly wage.

Social Security

  • Social pension for the elderly (income-tested): Age 65 (men) or 62 (women), and not receiving any other government or nongovernment benefits. The pension is only available to one member of a family. The yearly income of the recipient shall not exceed 10,000 taka. Benefit payments are prioritized by a designated committee, with the most vulnerable and women receiving preference (of those selected, at least half must be women). Social security disability pension (income-tested): Must be at least 6 years old, have a sensory, mental, verbal, or physical handicap, and not be receiving any other government or nongovernment assistance.
  • The yearly income of the recipient shall not exceed 36,000 taka. Benefit payments are prioritized by a designated committee, with priority given to the most vulnerable. Survivor social pension (income tested): Paid to widows and women who have been divorced or abandoned by their spouses and are not receiving any other government or nongovernment benefits.

Retirement

Within the following year, the government plans to implement a pension program for all people over the age of 60. Except for the governmental sector, there are no pension options in Bangladesh. In certain private sector and autonomous entities, there is the option of a provident fund and gratuity. Meanwhile, as part of its social safety net policy, the government distributes an old age allowance.

Health

On average, Bangladeshi people must pay 63.3 percent of the overall cost, with the remainder covered by the government. This system places a tremendous financial strain on low-income families, often compelling them to postpone treatment or incur debt. The government must expand healthcare funds to alleviate this strain.

Taxation Method

Residence Requirements

An individual is considered a resident of Bangladesh if he or she spends 182 days or more in any income year, or 90 days or more in any income year if he or she had previously spent more than 365 days in Bangladesh in the four prior years.
